Being no expert on this particular case, I do believe it´s the other way around. The Killers came in 1946 and Dragnet in 1951.

No - the dragnet theme came first. Rosza unknowingly used it in this film which caused a lawsuit. Rosza never needed to steal ideas as he was a melodic genius, but simple themes often find their way into different pieces of music without being outright violations of copyright.

You may be right. I read once that the theme used for both was written before the movie and before the 1949 radio show, but I do not remember exactly where. It was in a history of film music book, I think. Still, the dates you gave make it seem like my source was wrong. Thanks for the enlightenment!
